Please read these Terms and Conditions (“Terms”, “Terms and Conditions”) carefully before using the https://eventleadershipinstitute.com website operated by Event Leadership Institute (“ELI”, “us”, “we”, or “our”), or before registering to attend a webinar, seminar, conference, or event produced, managed, hosted, or sponsored by Event Leadership Institute, whether online or in-person or registering / purchasing any other service or product from Event Leadership Institute (the “Service”).
Your access to and use of the Service is conditioned upon your acceptance of and compliance with these Terms. These Terms apply to all visitors, users and others who wish to access or use the Service.
By accessing or using the Service you (“your”, “purchaser(s)”, “subscriber(s)”, “member(s)”, “customer(s)”, “student(s)”, or “learner(s)”) agree to be bound by these Terms. If you disagree with any part of the terms then you do not have permission to access the Service.
Purchases
If you wish to purchase any product or service made available through the Service (“Purchase”), you may be asked to supply certain information relevant to your Purchase including, without limitation, your credit card number, the expiration date of your credit card, your billing address, and your shipping information.
You represent and warrant that: (i) you have the legal right to use any credit card(s) or other payment method(s) in connection with any Purchase; and that (ii) the information you supply to us is true, correct and complete.
The service may employ the use of third-party services for the purpose of facilitating payment and the completion of Purchases. By submitting your information, you grant us the right to provide the information to these third parties subject to our Privacy Policy.
We reserve the right to refuse or cancel your order at any time for reasons including, but not limited to: product or service availability, errors in the description or price of the product or service, error in your order, for or other reasons.
We reserve the right to refuse or cancel your order if fraud or an unauthorized or illegal transaction is suspected.
Email Communication
By registering to access and use the service, you agree to receive email communication from Event Leadership Institute, LLC according to our Privacy Policy. You will receive essential information by email to the email address that you provided upon registration and/or purchase. It is your responsibility to ensure that the email address you provided is valid and entered correctly, as well as to ensure that your email service is able to receive emails from Event Leadership Institute.
Payments – Professional Development Courses
Payments can be made by Visa, MasterCard, or American Express. Learners with overdue accounts will have their accounts placed on hold and will not be permitted to access their current courses, register for or attend further modules or courses, or receive their certificate or digital credentials until such time that payments have been made and their account is up to date.
Payments – Events & Webinars
Payments can be made by Visa, MasterCard, or American Express. Customers with overdue accounts will have their accounts placed on hold and will not be permitted to access the event until such time that payments have been made and their account is up to date. Any and all other costs associated with your attendance shall be borne solely by you, and Event Leadership Institute shall have no liability for such costs.
Payment Plans
Payment plans for selected courses and services are offered on checkout through Affirm, Inc. Event Leadership Institute does not offer or manage payment plans directly. When applying for a payment plan, you are doing so directly with Affirm, Inc. and NOT Event Leadership Institute. Use License
Event Leadership Institute hereby grants the purchaser a limited, non-exclusive, non-sublicensable, and non-transferable license to view videos, content, webinars, live events, pre-recorded events, conferences, seminars, classes and any supporting materials (“materials”), according to the provisions contained herein, and subject to the payment of the applicable registration and/or class fees and adherence to these Terms. This is the grant of a license, not a transfer of title, and under this license you may not:
- modify or copy the materials;
- record, live stream, videotape, broadcast audio or video of any materials;
- use the materials for any commercial purpose, or for any public display (commercial or non-commercial);
- attempt to decompile or reverse engineer any software or materials contained on Event Leadership Institute, LLC’s website;
- remove any copyright or other proprietary notations from the materials; or
- transfer the materials to another person or “mirror” the materials on any other server.
This license shall automatically terminate if you violate any of these restrictions and may be terminated by Event Leadership Institute at any time. Upon terminating your viewing of these materials or upon the termination of this license, you must destroy any downloaded materials in your possession whether in electronic or printed format.
All courses, programs and content purchased on the ELI site are licensed for individual use only. Group Plans are available for purchase for teams. For more information on Group Plans, please contact [email protected].
Availability, Access, Errors, and Inaccuracies
We are constantly updating product and service offerings on the Service. We may experience delays in updating information on the Service and in our advertising on other websites. The information found on the Service may contain errors or inaccuracies and may not be complete or current. Products or services may be mispriced, described inaccurately, or unavailable on the Service, and we cannot guarantee the accuracy or completeness of any information found on the Service.
The materials appearing on Event Leadership Institute’s website could include technical, typographical, or photographic errors. Event Leadership Institute does not warrant that any of the materials on its website are accurate, complete, or current. Event Leadership Institute may make changes to the materials contained on its website at any time without notice. Event Leadership Institute does not, however, make any commitment to update the materials.
We, therefore, reserve the right to change or update information and to correct errors, inaccuracies, or omissions at any time without prior notice.
Event Leadership Institute will take all commercially reasonable efforts to provide uninterrupted Access to our site and services. However, from time to time, purchasers may be unable to access the site or services due to conditions beyond our control. Such conditions include, but are not limited to: force majeure, acts of God, power outages, and the acts of cyber attacks or computer hackers and others acting outside the law. Also, from time to time, access may be unavailable due to software issues, server downtime, increased Internet traffic or downtime, programming errors, regular maintenance of the system, and other related reasons. In response to any unavailability of the site to its class purchasers, we will take all commercially reasonable steps to ensure access is restored within a reasonable period of time. The term “commercially reasonable,” as used in these Terms, shall mean reasonable efforts taken in good faith without an unduly or burdensome use or expenditure of time, resources, personnel or money.
Event Leadership Institute endeavors to provide the highest quality content to its Subscribers. To that end, we reserve the right, in our sole discretion, to change, modify, or discontinue any aspect or feature of this site and services in whole or in part, including, without limitation, the content, availability, access and/or the terms of this site. Such changes, modifications, additions or deletions will be effective immediately upon notice thereof, which notice may be made by posting such changes on this Site.
Users are solely responsible for ensuring that they have sufficient and compatible hardware, software, telecommunications equipment and Internet service necessary for use of the Site.
Events & Webinars
Event Leadership Institute, in its sole discretion, reserves the right to change any and all aspects of events, seminars, virtual events, conferences, and webinars (“event”, or “events”), including but not limited to, the name, themes, content, program, speakers, performers, hosts, moderators, venue, and time. Content may be recorded and distributed or made available to paid participants following the event at Event Leadership Institute’s sole discretion, however, this is not guaranteed.
By registering for an event you agree not to sell, trade, transfer or share your access link and/or code, unless such transfer is granted by the Event Leadership Institute. If Event Leadership Institute determines that you have violated this policy, ELI may cancel your access, retain any payments made by you, report you to law enforcement authorities, and ban you from future Virtual Events.
You acknowledge and agree that ELI reserves the right to remove you from an event if in its sole discretion, determines that your participation or behaviour create a disruption or hinder the event or the enjoyment of the event content by other attendees, or violate our Code of Conduct policy.
Media Release & Use of Likeness
By accessing or using the Service or participating in any classes, webinars or live events, you acknowledge and agree to grant Event Leadership Institute the right to record, film, live stream, photograph, or capture your likeness in any media now available or hereafter developed and to distribute, broadcast, use, or otherwise globally to disseminate, in perpetuity, such media without any further approval from you or any payment to you. This grant to Event Leadership Institute includes, but is not limited to, the right to edit such media, the right to use the media alone or together with other information, and the right to allow others to use or disseminate the media.
Account Expiration – Professional Development Courses
Learners enrolled in online professional development courses will be provided access to the Event Leadership Institute learning website. Four (4) weeks following the course end date, as indicated above, the learner’s account will expire and be closed. It is the learner’s responsibility to ensure that they have backed up and/or downloaded any materials that they would like to keep for future reference.
Please note, course access for the Pandemic On-Site Protocol Training Course will end on the last day (day 7) of the course, and the learner’s account will expire and be closed. It is the learner’s responsibility to ensure that they have backed up and/or downloaded any materials that they would like to keep for future reference.
Contests, Sweepstakes, and Promotions
Any contests, sweepstakes, or other promotions (collectively, “Promotions”) made available through the Service may be governed by rules that are separate from these Terms Conditions. If you participate in any Promotions, please review the applicable rules as well as our Privacy Policy. If the rules for a Promotion conflict with these Terms and Conditions, the Promotion rules will apply.
Subscriptions
Some parts of the Service are billed on a subscription basis (“Subscription(s)”). You will be billed in advance on a recurring and periodic basis (“Billing Cycle”). Billing cycles are set either on a monthly or annual basis, depending on the type of subscription payment plan you select when purchasing a Subscription.
At the end of each Billing Cycle, your Subscription will automatically renew under the exact same conditions unless you cancel it or Event Leadership Institute cancels it. You may cancel your Subscription renewal either through your online account management page or by contacting Event Leadership Institute customer support team. Please note the resigning member shall be responsible for payment of all outstanding dues and fees and shall not be entitled to a refund of dues.
A valid payment method, including credit card or PayPal, is required to process the payment for your Subscription. You shall provide Event Leadership Institute with accurate and complete billing information including full name, address, state, zip code, telephone number, and a valid payment method information. By submitting such payment information, you automatically authorize Event Leadership Institute to charge all Subscription fees incurred through your account to any such payment instruments.
Should automatic billing fail to occur for any reason, Event Leadership Institute will issue an electronic invoice indicating that you must proceed manually, within a certain deadline date, with the full payment corresponding to the billing period as indicated on the invoice.
Fee Changes
Event Leadership Institute, in its sole discretion and at any time, may modify the Subscription fees for the Subscriptions. Any Subscription fee change will become effective at the end of the then-current Billing Cycle.
Event Leadership Institute will provide you with a reasonable prior notice of any change in Subscription fees to give you an opportunity to terminate your Subscription before such change becomes effective.
Your continued use of the Service after the Subscription fee change comes into effect constitutes your agreement to pay the modified Subscription fee amount.
Refunds
At the Event Leadership Institute we stand behind our content. If, for any reason, you are not satisfied with your purchase, we will refund 100% of your payment within 30 days of your purchase date for on-demand individual courses and annual subscriptions. Annual subscribers on a monthly payment plan can cancel at any time but will be responsible for the full annual fee if cancellation is more than 30 days after purchase. For Professional Development Courses, we will refund 100% of your course payments providing you provide written notice of withdrawal within 30 days after the final day of your course. For events, webinars, or conferences (online or in-person), we will refund 100% of your registration providing you provide a written request for refund no later than 10 business days after the end of the event. Refunds are limited to the timeframes listed above. We are not able to provide refunds beyond these limits.
Course Cancellation or Delay
In the event that a scheduled course does not have sufficient enrollment to maintain an effective and engaging learning environment, or another circumstance occurs that prevents a course from being delivered, the course may be cancelled, postponed, or re-scheduled at Event Leadership Institute’s discretion.
Should a cancellation occur, the Learner may be offered the option to select from and enroll into an upcoming scheduled course at the same level, or withdraw from the program. In the event of a withdrawal, the Learner will receive a full refund within 14 business days upon receipt of a written withdrawal request. Event Leadership Institute is not responsible for any costs incurred by the Learner as a result of a cancelled course including but not limited to; travel, accommodation, internet, telephone, technology, equipment, or other expenses.
Event Cancellation or Delay
If Event Leadership Institute is prevented from carrying out its obligations as it pertains to a webinar or event you registered for as a result of any cause beyond its control, or such webinar or event cannot be delivered because of a software or issue with the hosting platform or due to acts of God, strikes, labour disputes, government requisitions, restrictions or war or apparent act of war, terrorism, disaster, civil disorder, epidemic or pandemic, curtailment or restriction on transportation facilities, or any other comparable calamity, casualty or condition (collectively a “Force Majeure”) Event Leadership Institute shall have the right to immediately terminate the affected webinar or event without liability and shall be relieved of its obligations to you. If the affected webinar or event is terminated due to a Force Majeure occurrence before the first day of the event, then Event Leadership Institute will reschedule the affected webinar or event and your registration fee will be applied to the rescheduled event.
Confidentiality Agreement
The Learner understands that the Program is a private and personal experience for each Learner that participates in the Program. The Learner agrees to respect the confidentiality of all Learners participating in the program and their statements and actions, and agrees to keep all such information private and confidential.
Program Completion Policies
The maximum time frames to complete Event Leadership Institute professional development programs are provided at the beginning of each program and/or course. On-Demand subscription courses do not have completion deadlines.
For professional development courses, each required course or module must be successfully completed in sequential order as per the schedule provided. All documents, quizzes, exams, or other required assignments must be completed and submitted within the maximum program completion timeframe indicated at the start of the program or course.
In the event that a Learner is unable to complete all of the course and/or program requirements for any reason within the maximum allowable time frame, their official record will be marked as “Incomplete” indicating that they have not met the requirements for successful completion. In such cases, the Learner will no longer be eligible to receive a program Certificate (for certificate programs), CMP credit hours, or Digital Credential, and will be required to repeat the course, program, or portion of a program at the Learners’ expense.
Program Extension
In the event that a Learner experiences a mitigating circumstance which prevents them from completing course and/or program requirements within the maximum allowable timeframe or program end date / deadline, the Learner may apply for an extension. An application for program extension must be made in writing to [email protected]. Extensions are reviewed on a case-by-case basis and application alone does not guarantee acceptance, as it might be in the best interest of the Learner to repeat the course and/or program.
ELI offers extended access to Professional Development Courses on a monthly basis for a maximum of three months. The course extension fee must be purchase within three months of the course end date and can only be extended up to three months from the course end date. The non-refundable extension fee is $50 USD per month. Extensions must be applied for and must be approved prior to making a purchase. Should a Learner be required to repeat a course due to unsuccessful completion, regular tuition fees apply for the repeated course(s) or program(s). Event Leadership Institute may choose to waive these fees under special circumstances at its discretion.
*Exception: Please note, Program Extension policies are not applicable for the Pandemic On-Site Protocol Training Course. In the event a Learner is unable to complete the course and/or program requirements within the maximum allowable time frame or program end date/deadline, the Learner will be required to re-take the course at their expense to complete the course.
Exam Proctoring
ELI has partnered with an online proctoring service to help administer final exams for some courses. Once the testing window has been announced, learners may schedule their exam directly with the proctoring service. After logging into the testing website, a proctor will verify the learner’s identify and administer the exam. Learners are required to have a web camera for the test, as well as download a chat applet so that the proctor may view your desktop and speak with you in real-time. Please contact our customer support team for additional information or questions on this process.
Certificates of Completion
All learners will receive a Certificate of Completion for their given course or program providing that they have met the minimum requirements for completion including all assessments, assignments, quizzes, webinars, videos and other content including participation and engagement in discussions and other group activities where applicable, as well as earn the specified minimum score on their final exam.
Digital Credentials
For courses offering a Digital Credential, learners must obtain the minimum specified score on their final exam in order to qualify to receive the credential. Should learners not meet this requirement, they may choose to re-take the exam to make another attempt at achieving the minimum score. Final exam re-take policies and fees apply as per the following section.
Final Exam & Re-Takes
In the event that a Learner does not meet the minimum required passing score for the final exam, they may choose to re-take the exam. The exam re-take fee is $75 USD per exam re-take. The maximum amount of exam re-takes is two. This means that learners have up to a maximum of three attempts to successfully complete the final exam. After the third unsuccessful attempt, learners will be required to re-take the course or program at their expense before making another attempt.
*Exception: Please note, Final Exam and Re-Take policies are not applicable for the Pandemic On-Site Protocol Training Course. In the event a Learner does not meet the minimum required passing score for the final exam, learners will be required to re-take the course at their expense before making another attempt.
Continuing Education Credits & Hours
Many Event Leadership Institute classes provide Continuing Education credits toward the CMP designation. The exact credit amount is posted on each individual class page and learners are required to complete all lesson requirements in order to earn the associated credit for that course. For Certificate Courses, learners must earn a minimum specified score on their final exam in order to receive associated CMP credits for the given course.
Academic Honesty
The Event Leadership Institute has a zero tolerance policy regarding academic dishonesty. This includes but is not limited to plagiarism, cheating of any kind including; falsely completing courses, manipulating systems to mark courses complete, in course assignments and assessments or during exams, submitting another person’s work as one’s own, using materials without properly identifying and citing them, or illegal use of copyright material. In the event a learner is deemed to have violated this policy, they will be dismissed from membership, the program and/or course and will no longer be eligible to receive a transcript, certificate of completion or digital credential, or refund.
Code of Conduct
- Deliberate intimidation, stalking or harassment;
- Pornographic material or explicit content (sexual or violent in nature);
- Disruptive behaviour, especially during talks, presentations, events, lessons, live classes, webinars, or other activities;
- Hateful or highly offensive content, including personal insults or content that attacks or dehumanizes a person based on gender, gender identity, age, sexual orientation, disability, physical appearance, body size, race, age, religion, or political affiliation;
- Profanity;
- Spam;
- Misleading, fraudulent or deceptive content;
- Illegal content or activities.
Learning Library Course Policies
Learning Library courses included in monthly or annual subscriptions do not have expiry dates, however are only accessible while your subscription is active and in good standing.
Accounts
When you create an account with us, you guarantee that you are above the age of 18, and that the information you provide us is accurate, complete, and current at all times. Inaccurate, incomplete, or obsolete information may result in the immediate termination of your account on the Service.
You are responsible for maintaining the confidentiality of your account and password, including but not limited to the restriction of access to your computer and/or account. You agree to accept responsibility for any and all activities or actions that occur under your account and/or password, whether your password is with our Service or a third-party service. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.
We reserve the right to refuse service, terminate accounts, remove or edit content, or cancel orders in our sole discretion.
Intellectual Property
The Service and its original content, features and functionality are and will remain the exclusive property of Event Leadership Institute and its licensors. The Service is protected by copyright, trademark, and other laws of both the United States and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of Event Leadership Institute.
Links To Other Web Sites
Our Service may contain links to third-party websites or services that are not owned or controlled by Event Leadership Institute.
Event Leadership Institute has no control over, and assumes no responsibility for the content, privacy policies, or practices of any third-party websites or services. We do not warrant the offerings of any of these entities/individuals or their websites.
You acknowledge and agree that Event Leadership Institute shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on or through any such third party web sites or services.
We strongly advise you to read the terms and conditions and privacy policies of any third-party websites or services that you visit. The inclusion of any link does not imply endorsement by Event Leadership Institute of the site. Use of any such linked website is at the user’s own risk.
Termination
We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms.
If you wish to terminate your account, you may simply discontinue using the Service.
All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity and limitations of liability.
Indemnification
You agree to defend, indemnify and hold harmless Event Leadership Institute and its licensee and licensors, and their employees, contractors, agents, officers and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney’s fees), resulting from or arising out of a) your use and access of the Service, by you or any person using your account and password, or b) a breach of these Terms.
Limitation Of Liability
In no event shall Event Leadership Institute, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.
Disclaimer
Your use of the Service is at your sole risk. The Service is provided on an “AS IS” and “AS AVAILABLE” basis. The Service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement or course of performance.
Event Leadership Institute its subsidiaries, affiliates, and its licensors do not warrant that a) the Service will function uninterrupted, secure or available at any particular time or location; b) any errors or defects will be corrected; c) the Service is free of viruses or other harmful components; or d) the results of using the Service will meet your requirements.
Exclusions
Some jurisdictions do not allow the exclusion of certain warranties or the exclusion or limitation of liability for consequential or incidental damages, so the limitations above may not apply to you.
Governing Law
These Terms shall be governed and construed in accordance with the laws of the State of New York, United States, without regard to its conflict of law provisions.
Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our Service, and supersede and replace any prior agreements we might have had between us regarding the Service.
Changes
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will provide at least 30 days notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you are no longer authorized to use the Service.
